Non-working holidays

Article 112 Labor Code Russian Federation The following non-working holidays are established in the Russian Federation:

• January 1, 2, 3, 4, 5, 6 and 8 – New Year holidays;
• January 7 – Christmas;
• February 23 – Defender of the Fatherland Day;
• March 8 – International Women's Day;
• May 1 – Spring and Labor Day;
• May 9 – Victory Day;
• June 12 – Russia Day;
• November 4 – Day national unity.

According to Article 6 of the Labor Code of the Russian Federation, laws and other regulatory legal acts of state authorities of the constituent entities of the Russian Federation may establish additional non-working holidays. The corresponding norm is also contained in the Resolution of the Presidium of the Supreme Court of the Russian Federation dated December 21, 2011 No. 20-ПВ11 and in paragraph 8 of the letter of the Ministry of Labor of Russia dated July 10, 2003 No. 1139-21.

Additionally non-working holidays may be announced religious holidays in the manner provided for in Part 7 of Art. 4 of the Federal Law of September 26, 1997 No. 125-FZ.

Transfer of days off

In accordance with part five of Article 112 of the Labor Code of the Russian Federation, for the purpose of rational use by employees of weekends and non-working holidays, weekends may be transferred to other days by federal law or a regulatory legal act of the Government of the Russian Federation.

In 2017, in accordance with the Decree of the Government of the Russian Federation dated August 4, 2016 No. 756 “On the transfer of weekends in 2017,” the following weekends were postponed:

• from Sunday January 1 to Friday February 24;
• from Saturday 7 January to Monday 8 May.

Part two of Article 112 of the Labor Code of the Russian Federation determines that if a weekend and a non-working holiday coincide, the day off is transferred to the next working day after the holiday, with the exception of weekends coinciding with non-working holidays from January 1 to January 8. Two days off from the above days off (i.e. from January 1 to January 8) for other days in the next calendar year transferred by the Government of the Russian Federation.

Due to the fact that by Decree of the Government of the Russian Federation dated August 4, 2016 No. 756, two days off were postponed in 2017 (January 1 and January 7), January 8, 2017 is not automatically transferred to the next working day after the holiday.

Thus, taking into account the postponement of holidays in 2017, “ New Year holidays» for employees will last 8 days - from January 1 to January 8, 2017.

In April-May 2017, employees will rest from April 29 to May 1 in connection with the celebration of Spring and Labor Day, as well as from May 6 to 9 in connection with the celebration of Victory Day.

In June, the rest period in connection with the celebration of Russia Day will last 3 days (June 10 - 12), and in November in connection with the celebration of National Unity Day - from November 4 to 6, 2017.

Determination of standard working hours

In accordance with the Procedure approved by Order of the Ministry of Health and Social Development of Russia dated August 13, 2009 No. 588n, the standard working time is calculated depending on the established duration of working hours per week according to the calculated schedule of a five-day working week with two days off on Saturday and Sunday based on the duration of daily work (shift ). So, with a 40-hour work week, the standard working time is 8 hours, with a work week of 36 hours it will be 7.2 hours, with a 24-hour work week – 4.8 hours.

According to Part 1 of Article 95 of the Labor Code of the Russian Federation, the duration of the working day or shift immediately preceding the non-working holiday, decreases by one hour. In 2017, employees will work one hour less on February 22, March 7, and November 3.

The standard working time calculated in the specified order applies to all work and rest regimes.
